The TLANZ Public and Administrative Law Committee has published a submission on the Bill expanding Police powers, responding to calls for clarity following recent judicial and regulatory scrutiny.
The Public and Administrative Law Committee supports the objective of providing that clarity and agrees with the concerns already raised by the Criminal Law and Technology & Law Committees on Part 1 of the Bill. However, the Committee has significant concerns that the Bill, as currently drafted, goes beyond clarification and materially expands coercive Police powers without corresponding statutory constraints.
In this submission, the Committee approaches those concerns through a public and administrative law lens, focusing on legality and legal certainty, proportionality, the proper limits of executive discretion, and the adequacy of statutory safeguards.
