The TLANZ Criminal Law Committee has published a submission on the Trespass (Specified Retail Premises and Other Matters) Amendment Bill.
The Criminal Law Committee raises significant concerns that the Bill, as currently drafted, expands liability, lowers knowledge thresholds, increases penalties, and hands private actors greater enforcement power without adequate safeguards. In the Committee’s view, this creates a material risk of over-criminalisation and disproportionate outcomes.
In this submission, the Committee examines how the Bill shifts the trespass regime from a reactive model toward a preventive exclusion model and identifies where that shift engages rights and values protected by the New Zealand Bill of Rights Act 1990, including the presumption of innocence and protection against arbitrary enforcement.
