Civil Litigation – A Guide to Crafting Written Evidence (2026) (On Demand)

The written statements of witnesses are an important – and often determinative – part of any civil proceeding. Whether in the form of briefs of evidence, witness statements, affidavits, or “will say” statements, each document provides the opportunity to ensure what the witness can say is conveyed to the Court and to the other parties, and that your case is presented in the strongest way possible. Preparing these documents will also force you to grapple fully with the detail of – or holes in – the evidence in your case, so you are as informed and prepared as you can be in the lead-up to trial.

This On Demand will cover the fundamentals of the preparation of written evidence, including procedural obligations, requirements under the court rules (including under the amended High Court Rules), and some practical tips.

Learning Outcomes

  • Learn about the differences between affidavits, briefs of evidence, witness statements and "will say" statements, and the rules that apply to each.
  • Receive practical advice regarding the preparation of written statements of witnesses, from the selection of witnesses, to briefing witnesses, to then putting pen to paper.
  • Discover what recent court decisions can teach us about the best approach in the preparation of written evidence (and what to avoid).
  • Brush up on the technical formalities for briefs of evidence, witness statements, affidavits and their accompanying exhibits.

Bridgette White

Bridgette is an experienced commercial, regulatory and insolvency litigator. She has expertise in complex contractual and commercial disputes, regulatory investigations and enforcement activity, fair trading and consumer protection claims as well as insolvency claims (including breaches of directors' duties).

Bridgette is recognised as a leading barrister in the Legal 500 Asia Pacific Guide 2025 in which she is described as being “a great communicator. She had tremendous people skills and strong litigation instincts.” She is further listed in Doyle's Guide 202 as a Leading Insolvency and Restructuring Barrister in New Zealand.  Bridgette is also recognised as a leading litigation, insolvency and restructuring lawyer in New Zealand by Best Lawyers 2025 Guide.

Before joining Bankside, Bridgette was a senior litigator at Russell McVeagh. She has appeared in the District and High Courts and the Court of Appeal (as both sole and junior counsel) and has experience in mediations, arbitrations and authority hearings.

Joanna Trezise

Joanna is a Special Counsel in Russell McVeagh's litigation team. She acts and advises on a broad range of complex disputes, with a focus on trust, estate and relationship property disputes. Joanna is also frequently instructed on regulatory investigations and enforcement proceedings, particularly in the financial sector, and other commercial, tort, statutory, cross-border and class action disputes. With a previous career in the arts, Joanna has a particular interest in matters relating to arts and culture.

Joanna has acted for clients in negotiations, mediations, arbitrations, adjudications and judicial settlement conferences, in proceedings before the District Court, Family Court, High Court and Court of Appeal, and in disciplinary matters before the Legal Complaints Review Officer, the Real Estate Agents Disciplinary Tribunal, and the Teaching Council of Aotearoa New Zealand.

She publishes and speaks regularly on legal issues.
