The Law Association of New Zealand

Privilege for Civil Practitioners (2026) (On Demand)

This On Demand was recorded on 25 June 2026.

Although privilege is at the core of our professional obligations as lawyers, it is a concept that is sometimes more readily asserted than understood. This creates two equal but opposite risks for lawyers: failing to safeguard confidential client information or, alternatively, acting on the (incorrect) assumption that communications are protected.

This On Demand will cover the principles behind privilege, the most common forms of privilege, developments in the law, and practical tips for lawyers.

Learning Outcomes

  • Develop a better understanding about the basis for privilege.
  • Delve into the similarities and difference between common law and statutory privilege.
  • Look into common mistakes about, and exceptions to, privilege.
  • Review case law and potential developments in this area.
