Compensation Claims under the Agreement for Sale and Purchase of Real Estate

The compensation clause under the TLANZ-REINZ Agreement for Sale and Purchase of Real Estate – ‘Clause 10’ – is a significant provision for both purchasers and vendors, and their legal representatives. Yet, whether due to time pressures or for other reasons, the clause is often misunderstood or misapplied. 

In this webinar, Hermann Grobler, a member of TLANZ’s Property Disputes Committee, will guide you through the clause’s content and process – including the amendments that took effect on 21 April 2026 under the revised ASPRE – and address common errors with its use.

Hermann Grobler

Hermann specialises in property and commercial law. He has acted for vendors and purchasers in a variety of commercial property transactions and residential transactions. He has considerable development/subdivision experience and undertakes all aspects of these.   

Hermann has considerable expertise in the lending and finance field, with particular focus in acting for non-bank lenders and complex refinance deals.

He is frequently instructed in relation to property disputes with the aim of achieving a pragmatic and commercial outcome. Hermann has been a member of the Property Disputes Committee since 1 October 2022 and has assisted with the review of the Rulings Manual.
