The Law Association of New Zealand

Disclosure Under the Trusts Act

This session will examine the statutory disclosure obligations introduced by the Trusts Act 2019, which has significantly redefined trustees’ duties in relation to beneficiary information. Participants will gain a practical understanding of the presumption in favour of disclosing basic trust information, the statutory grounds for withholding disclosure, and the interpretive approaches emerging in case law.

The webinar will also consider the evolving scope of trustee discretion and its impact on trust administration, documentation standards, and risk mitigation strategies.

Learning Outcomes

  • Understand the key disclosure obligations imposed by the Trusts Act 2019, including the presumption of disclosure and exceptions.
  • Apply the statutory factors trustees must consider when deciding whether to withhold trust information.
  • Recognise practical challenges and legal risks arising from disclosure duties in common trust scenarios.
