Drafting Wills – s 55 PPPR Act Applications

Preparing a s 55 will on behalf of a subject person requires careful judgment, sound drafting, and a clear understanding of what needs to happen next via the probate process. 

This webinar will explore when a s 55 will is appropriate, key practical and procedural considerations, and common challenges practitioners may face in obtaining probate of a s 55 will. It will also address best practice in drafting the will and supporting affidavit, as well as the role of the lawyer acting for the Subject Person.

Theresa Donnelly

Theresa graduated from Auckland University in 1992 and has a wealth of experience in Elder Law and Trust-related matters. Theresa was formerly from Public Trust (Senior Solicitor and Team Leader) and the Ministry of Social Development where she was lead Senior in the Public Law Team, working with Parliamentary Counsel, Older People’s Policy and the Office of Senior Citizens. Theresa worked on the 2017 changes to the EPA forms. She is a regular presenter to professional groups such as TLANZ, NZLS, CCH, STEP, and Legalwise, and is known for her practical approach.

Mary Rozeboom

Mary Rozeboom graduated from the University of Waikato in 2013, with a Bachelor of Laws with First Class Honours.  Mary has spent time advising on trust administration and provided key support during the implementation of resultant changes following the commencement of the Trusts Act 2019.  Mary also spends a lot of time working in the PPPR space, and enjoys seeing results for the protection of vulnerable New Zealanders.
