Property Agreement Cancellation – Getting It Right (and Avoiding Professional Exposure)

Although settlement, ideally achieved smoothly and efficiently, is the aim for agreements of sale and purchase of real estate, not all transactions proceed to that point [do you have a percentage or similar statistic on cancellation rate?]. When cancellation does occur, often it is treated as a straightforward step – yet it actually involves several legal and procedural steps which, if not effected correctly, hold significant consequences for clients and their legal advisers.

Kchitij Tiwari

Kchitij Tiwari (KT) is the Director of Jury Law Limited, a high-volume property and business conveyancing practice in Auckland. His work spans residential and commercial conveyancing, business sale and purchase transactions, trust structuring, and complex settlement advisory.

Through handling close to 100 transactions per month, KT works at the coalface of real-time conveyancing issues. His practice frequently involves advising on conditional contracts, due diligence complexities, assignment and consent issues, vendor finance, cross-lease variations, and settlement risk.
