Remedies for Breach of Contract

Contractual relations are fundamental to business relationships.  But from time-to-time breaches occur.  When breaches occur, important decisions need to be made. The remedies that are available for a breach of contract are critical in assessing the best way to enforce rights, manage risk, and compensate parties for losses as a result of a breach of contract.

Knowledge of the available remedies is also important at the front end – it can assist in negotiating favourable terms and limiting liability when drafting contracts.

When bringing or facing a claim for a breach or a potential breach of contract, a key consideration will be what remedies are available and how this might impact your client. This webinar will explore the available monetary damages, enforcing performance and the use of injunctions.

Josh Suyker

Josh is a Barrister at Bankside Chambers, with particular expertise in commercial and contractual disputes; Regulatory investigations and proceedings, including matters involving the Commerce Commission, Financial Markets Authority and Serious Fraud Office; Insolvency proceedings; Judicial review and human rights proceedings; and, Criminal proceedings, particularly those involving allegations of fraud.
He has acted in a range of commercial, regulatory, public and criminal cases. He has appeared as sole counsel in the District Court, High Court and Court of Appeal and has represented clients at specialist tribunals and forums for alternative dispute resolution. Josh is also a member of the board of trustees of the Auckland Community Law Centre.
