Spousal Maintenance Applications

Spousal maintenance is an important aspect of the financial arrangements after separation – much needed by the applicant and often resisted by the respondent. It’s an area where lawyers need to navigate the interface of financial needs post-separation with legal complexities.

This webinar will provide an update on recent case law and its implications. It will also explore managing client expectations, and practical advice addressing challenges in preparing and navigating the legal process for spousal maintenance applications including:

  • The framework of maintenance applications 
  • How the Court will approach a situation where a respondent has insufficient income but access to trust or other resources
  • When interim spousal maintenance can include legal and accounting fees
  • What can be included as a party’s reasonable needs

Helen Radinovich

Helen practises in all areas of family law, including relationship property, trust and estate claims, spousal maintenance, care of children and family violence. She has been on TLANZ’s Family Law Committee since 2018 and the NZLS’ Family Law Section Advisory Panel since 2019. Helen regularly presents seminars on family law topics. Helen is a legal aid provider.

Isabella Stevenson

Isabella has been a barrister sole since 2024 and is a member of Trinity Chambers in Auckland. She practises exclusively in family law and has a particular interest in relationship property and spousal maintenance, and complex care of children disputes (care/contact and guardianship).
